ข้อตกลงสิทธิ์การใช้งานสำหรับผู้ใช้ปลายทาง (“EULA”) ฉบับนี้เป็นข้อตกลงทางกฎหมายระหว่างท่าน (“ผู้ใช้”) กับบริษัทสยามบล็อกเชน มีเดีย กรุ๊ป จำกัด (“บริษัท”) สำหรับการใช้งานแอปพลิเคชัน Siam Blockchain (“แอป”) บนอุปกรณ์มือถือ

การดาวน์โหลด ติดตั้ง หรือใช้งานแอปนี้ ถือว่าท่านยอมรับข้อกำหนดทั้งหมดใน EULA ฉบับนี้และ Apple Standard EULA หากท่านไม่ยอมรับข้อกำหนดเหล่านี้ กรุณาอย่าดาวน์โหลดหรือใช้งานแอป

1. การอนุญาตใช้งาน

บริษัทให้สิทธิ์แก่ท่านในการใช้งานแอปแบบจำกัด ไม่ผูกขาด ไม่สามารถโอนสิทธิ์ได้ และสามารถเพิกถอนได้ เพื่อใช้งานส่วนบุคคลและไม่ใช่เพื่อการค้าบนอุปกรณ์ที่ท่านเป็นเจ้าของหรือควบคุม ตามที่ได้รับอนุญาตภายใต้ Usage Rules ของ App Store ท่านไม่สามารถแจกจ่ายหรือเผยแพร่แอปผ่านเครือข่ายที่อุปกรณ์หลายเครื่องสามารถใช้งานพร้อมกันได้ ท่านไม่สามารถโอนสิทธิ์ แจกจ่ายซ้ำ หรือให้อนุญาตช่วงแอปได้ และหากท่านขายอุปกรณ์ ท่านต้องลบแอปออกก่อน ท่านไม่สามารถคัดลอก (ยกเว้นตามที่ได้รับอนุญาตจากสัญญาอนุญาตนี้) ทำวิศวกรรมย้อนกลับ ถอดแยก พยายามแยกซอร์สโค้ด ดัดแปลง หรือสร้างงานสืบเนื่องจากแอป (ยกเว้นในกรณีที่กฎหมายที่ใช้บังคับห้ามข้อจำกัดดังกล่าว)

2. การสมัครสมาชิกแบบต่ออายุอัตโนมัติ (Auto-Renewable Subscriptions)

แอปเสนอการสมัครสมาชิกแบบต่ออายุอัตโนมัติ (“Siam Blockchain Premium”) โดยมีรายละเอียดดังนี้:

  • ชื่อการสมัครสมาชิก: Siam Blockchain Premium
  • ระยะเวลา: รายเดือน หรือ รายปี
  • ราคา: แสดงในหน้าสมัครสมาชิกของแอป ราคาอาจแตกต่างกันตามภูมิภาคและอาจมีการเปลี่ยนแปลง
  • การชำระเงิน: เรียกเก็บผ่านบัญชี Apple ID หรือ Google Play ของท่าน
  • การต่ออายุอัตโนมัติ: การสมัครสมาชิกจะต่ออายุโดยอัตโนมัติเมื่อสิ้นสุดแต่ละรอบ เว้นแต่ท่านจะยกเลิกอย่างน้อย 24 ชั่วโมงก่อนวันสิ้นสุดรอบปัจจุบัน
  • การยกเลิก: ท่านสามารถจัดการหรือยกเลิกการสมัครสมาชิกได้ทุกเมื่อผ่านการตั้งค่าบัญชี App Store หรือ Google Play ของท่าน
  • ช่วงทดลองใช้ฟรี: หากมีการเสนอช่วงทดลองใช้ฟรี ส่วนที่ไม่ได้ใช้จะถูกริบเมื่อท่านซื้อสมัครสมาชิก

3. การยินยอมให้ใช้ข้อมูล

ท่านยินยอมให้บริษัทเก็บรวบรวมและใช้ข้อมูลทางเทคนิคและข้อมูลที่เกี่ยวข้อง รวมถึงแต่ไม่จำกัดเพียง ข้อมูลทางเทคนิคเกี่ยวกับอุปกรณ์ ระบบ ซอฟต์แวร์แอปพลิเคชัน และอุปกรณ์ต่อพ่วงของท่าน ซึ่งรวบรวมเป็นระยะเพื่ออำนวยความสะดวกในการให้บริการอัปเดตซอฟต์แวร์ การสนับสนุนผลิตภัณฑ์ และบริการอื่นๆ ที่เกี่ยวข้องกับแอป บริษัทอาจใช้ข้อมูลนี้เพื่อปรับปรุงผลิตภัณฑ์หรือให้บริการแก่ท่าน ตราบเท่าที่ข้อมูลอยู่ในรูปแบบที่ไม่สามารถระบุตัวตนของท่านได้

4. บริการภายนอก

แอปอาจเปิดให้เข้าถึงบริการและเว็บไซต์ของบริษัทและ/หรือบุคคลที่สาม (“บริการภายนอก”) ท่านตกลงที่จะใช้บริการภายนอกโดยยอมรับความเสี่ยงด้วยตนเอง บริษัทไม่รับผิดชอบในการตรวจสอบหรือประเมินเนื้อหาหรือความถูกต้องของบริการภายนอกใดๆ ข้อมูลที่แสดงในแอปหรือบริการภายนอก รวมถึงข้อมูลทางการเงิน ราคาสินทรัพย์ดิจิทัล และข้อมูลตลาด เป็นข้อมูลเพื่อการศึกษาทั่วไปเท่านั้น ไม่ได้รับการรับรองจากบริษัท และไม่ถือเป็นคำแนะนำทางการเงินหรือการลงทุน

5. ทรัพย์สินทางปัญญา

แอปและเนื้อหาทั้งหมด รวมถึงแต่ไม่จำกัดเพียง ข้อความ กราฟิก โลโก้ ไอคอน รูปภาพ และซอฟต์แวร์ เป็นทรัพย์สินของบริษัทและได้รับความคุ้มครองตามกฎหมายลิขสิทธิ์ของประเทศไทยและกฎหมายระหว่างประเทศ

6. การไม่รับประกัน

ท่านรับทราบและยอมรับอย่างชัดเจนว่าการใช้แอปเป็นความเสี่ยงของท่านแต่เพียงผู้เดียว ภายใต้ขอบเขตสูงสุดที่กฎหมายที่ใช้บังคับอนุญาต แอปและบริการใดๆ ที่ดำเนินการหรือจัดให้โดยแอปจัดให้ “ตามสภาพ” (AS IS) และ “ตามที่มีอยู่” (AS AVAILABLE) พร้อมข้อบกพร่องทั้งหมดและโดยไม่มีการรับประกันใดๆ ทั้งสิ้น บริษัทขอปฏิเสธการรับประกันและเงื่อนไขทั้งหมดที่เกี่ยวกับแอป ไม่ว่าจะโดยชัดแจ้ง โดยนัย หรือโดยกฎหมาย รวมถึงแต่ไม่จำกัดเพียง การรับประกันโดยนัยและ/หรือเงื่อนไขเกี่ยวกับความสามารถในเชิงพาณิชย์ ความเหมาะสมสำหรับวัตถุประสงค์เฉพาะ ความถูกต้อง และการไม่ละเมิดสิทธิ์ของบุคคลที่สาม

7. การจำกัดความรับผิด

ภายใต้ขอบเขตที่กฎหมายไม่ห้าม ไม่ว่าในกรณีใดก็ตาม บริษัทจะไม่รับผิดชอบต่อการบาดเจ็บส่วนบุคคล หรือความเสียหายโดยบังเอิญ ความเสียหายพิเศษ ความเสียหายทางอ้อม หรือความเสียหายที่เป็นผลสืบเนื่องใดๆ ทั้งสิ้น รวมถึงแต่ไม่จำกัดเพียง ความเสียหายจากการสูญเสียกำไร การสูญเสียข้อมูล การหยุดชะงักทางธุรกิจ หรือความเสียหายทางพาณิชย์อื่นๆ ที่เกิดจากหรือเกี่ยวข้องกับการใช้งานหรือการไม่สามารถใช้งานแอปได้ ไม่ว่าจะเกิดจากสาเหตุใดก็ตาม ไม่ว่าจะเป็นทฤษฎีความรับผิดใด (สัญญา ละเมิด หรืออื่นๆ) และแม้ว่าบริษัทจะได้รับแจ้งถึงความเป็นไปได้ของความเสียหายดังกล่าวแล้วก็ตาม ไม่ว่าในกรณีใด ความรับผิดทั้งหมดของบริษัทต่อท่านจะไม่เกินจำนวนห้าสิบดอลลาร์สหรัฐ ($50.00)

8. การยุติสัญญา

EULA ฉบับนี้มีผลบังคับใช้จนกว่าจะถูกยุติโดยท่านหรือบริษัท สิทธิ์ของท่านภายใต้ EULA ฉบับนี้จะสิ้นสุดลงโดยอัตโนมัติหากท่านไม่ปฏิบัติตามข้อกำหนดใดๆ เมื่อยุติสัญญา ท่านต้องหยุดใช้งานแอปและลบสำเนาทั้งหมดออกจากอุปกรณ์ของท่าน

9. กฎหมายที่ใช้บังคับ

EULA ฉบับนี้อยู่ภายใต้บังคับและตีความตามกฎหมายของราชอาณาจักรไทย ข้อพิพาทใดๆ ที่เกิดขึ้นจากหรือเกี่ยวข้องกับ EULA ฉบับนี้จะอยู่ภายใต้เขตอำนาจศาลของศาลไทย

This End User License Agreement (“EULA”) is a legal agreement between you (“User”) and Siam Blockchain Media Group Co., Ltd. (“Company”) for the use of the Siam Blockchain mobile application (“App”).

By downloading, installing, or using the App, you agree to be bound by the terms of this EULA and Apple’s Standard EULA. If you do not agree to these terms, do not download or use the App.

1. License Grant

The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices that you own or control and as permitted by the App Store Usage Rules. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the App and, if you sell your device, you must remove the App before doing so. You may not copy (except as permitted by this license), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App (except as and only to the extent that any foregoing restriction is prohibited by applicable law).

2. Auto-Renewable Subscriptions

The App offers auto-renewable subscriptions (“Siam Blockchain Premium”) with the following details:

  • Subscription Name: Siam Blockchain Premium
  • Duration: Monthly or Annual
  • Price: As displayed on the subscription page within the App. Prices may vary by region and are subject to change.
  • Payment: Charged to your Apple ID or Google Play account
  • Auto-Renewal: Subscriptions automatically renew at the end of each period unless canceled at least 24 hours before the end of the current period.
  • Cancellation: You may manage or cancel your subscription at any time through your App Store or Google Play account settings.
  • Free Trial: If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.

You agree that the Company may collect and use technical data and related information — including but not limited to technical information about your device, system and application software, and peripherals — that is gathered periodically to facilitate the provision of software updates, product support, and other services related to the App. The Company may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

4. External Services

The App may enable access to the Company’s and/or third-party services and websites (collectively, “External Services”). You agree to use the External Services at your sole risk. The Company is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services. Data displayed by the App or any External Service, including but not limited to financial information, cryptocurrency prices, and market data, is for general informational and educational purposes only and is not guaranteed by the Company or its agents. Such data does not constitute financial or investment advice.

5. Intellectual Property

The App and all content, including but not limited to text, graphics, logos, icons, images, and software, are the property of the Company and are protected by Thai copyright law and international treaties.

6. NO WARRANTY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ANY SERVICES PERFORMED OR PROVIDED BY THE APP ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS. SHOULD THE APP OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

7. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall the Company’s total liability to you for all damages exceed the amount of fifty dollars ($50.00).

8. Termination

This EULA is effective until terminated by you or the Company. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

9. Governing Law

This EULA is governed by and construed in accordance with the laws of the Kingdom of Thailand. Any disputes arising from or relating to this EULA shall be subject to the jurisdiction of the Thai courts.
